Right to manage Property Management Experts

The Right to Manage is the process undertaken by leaseholders of a residential unit to transfer property management away from the current landlord to a company set up by them, who may then appoint a new management agent.

This right is provided by the Commonhold and Leasehold Reform Act of 2002 so that residents who are unhappy with their management agent may change agents without the consent of the current landlord or a court.

Certain requirements must be met in order to qualify for the Right to Manage

  • The building must be self-contained and have a minimum of 2 flats
  • 50% of tenants must agree to participate in the newly founded RTM company.
  • Only 25% of the building space may be used for commercial purposes.
  • Qualifying tenants must have a lease that was originally granted for at least 21 years.
  • At least two thirds of the flats must be let to qualifying tenants.
The Process of a Right to Manage:
  1. Participating residents apply for the Right to Manage
  2. Right to Manage company is established
  3. Formal notice to non-participating residents served, detailing their rights to become members of the Right To Manage company
  4. Formal claim notice to landlord with date before which counter-claim may be served.
  5. Management is transferred to the RTM company
